Tribune to leave bankruptcy after 4 years

CHICAGO (AP) ? Tribune Co. announced it is emerging after more four years of bankruptcy.

Tribune said late Sunday the reorganized media company begins Monday with new ownership ? the senior creditors ? and a new board of directors: Bruce Karsh, Ken Liang, Peter Murphy, Ross Levinsohn, Craig A. Jacobson, Peter Liguori, and Eddy Hartenstein.

"Tribune will emerge from the bankruptcy process as a multimedia company with a great mix of profitable assets, strong brands in major markets and a much-improved capital structure," said Hartenstein, Tribune's chief executive officer.

Senior creditors Oaktree Capital Management, Angelo, Gordon & Co. and JPMorgan Chase & Co. will control of the new company. The Chicago Tribune reported late Sunday that Liguori, a former TV executive at Discovery and Fox, is expected to be named chief executive the reorganized Tribune Co.

Tribune, which was founded in 1847, publishes some of the best-known newspapers in the U.S., including the Los Angeles Times, The Baltimore Sun and the Chicago Tribune. It also owns WGN in Chicago and 22 other television stations, as well as the WGN radio station. The Tribune's report Sunday said that the new owners expect to sell all of the company's assets.

Tribune Co. sought bankruptcy protection in 2008, less than a year after billionaire developer Sam Zell led an $8 billion leveraged buyout that left the company with $13 billion in debt.

HOUSTON (AP) -- A spokesman says former President George H.W. Bush's condition continues to improve and that he was moved Saturday out of intensive care and into a regular hospital room.

Family spokesman Jim McGrath said in a statement Saturday that the Bushes thank everyone for their prayers and good wishes.

Bush was hospitalized Nov. 23 for treatment of a bronchitis-related cough. He was moved to intensive care at Houston's Methodist Hospital on Dec. 23 after he developed a fever.

Bush, the 41st president, is the country's oldest living former president by a few months.

Secondary Market

In contrast to anticipated 2012 sales declines in the U.S structured settlement primary market, industry experts interviewed by S2KM agree the U.S. structured settlement secondary market achieved record sales and profits in 2012.?

S2KM secondary market estimates for 2012 - based on interviews with industry experts:

  • 12,000 secondary market transfers - with less than 120 contested by annuity owners and/or providers.
  • $360 million of total secondary market purchases (money paid to transferors).
  • $30,000 average individual transfer.
  • Average discount rates in the low double digits - with the lowest average discount rates (high single digits) provided by AllState's commutations.
  • Total industry profit of $120 million calculated as follows:
    • $1 billion received from investors;
    • Less: $360 million paid to transferors;
    • Equals: $640 million of revenue;
    • Less: $520 million of expenses;
    • Equals: $120 million of profits.

Discount Rates

  • As explained by Earl Nesbitt, Executive Director of the National Association of Settlement Purchasers (NASP), during his presentation at the NASP 2011 Annual Meeting: the concepts of "discount rate" and "discounted present value" both play an important role in court hearings to evaluate structured settlement transfer proposals.
  • The Model State Structured Settlement Protection Act defines "discounted present value" to mean: "the present value of future payments determined by discounting such payments to the present using the most recently published Applicable Federal Rate for determining the present value of an annuity, as issued by the United States Internal Revenue Service."

  • Secondary market experts interviewed by S2KM agree generally that discount rates for structured settlement transfers were "low" during 2012 compared with prior years - especially when compared with 2009 when discount rates were exceptionally "high" as a result of the 2008 financial crisis.
  • "Average" discount rates are difficult to define because many factors determine the discount rate for a specific case. For examples: cost and availability of funds; single vs. multiple bid transactions; duration and amount of payments; and whether payments are certain or life contingent.
  • During his 2011 NASP presentation, Nesbitt summarized these results from a 2011 survey he conducted of the discount rates approved by judges in Harris County Texas:
    • The average discount rate: 15.8 percent;
    • The weighted average (i.e. taking into consideration the relative case size): 12.96 percent;
    • The lowest discount rate: 7.4 percent; and
    • The highest discount rate ($3494 paid for $7282 due in less than one year): 61.3 percent.

Market Shares

  • Industry experts interviewed by S2KM disagree on who controls what percentages of the structured settlement secondary market.
  • Estimates of the post-merger 2012 market share (revenue and sales) of the now-combined J.G. Wentworth and Peachtree Financial Solutions (JGW/Peachtree) vary from a low of 50% to a high of 75%.
  • The remaining 2012 market shares (revenue and number of transfers) are believed to be split relatively evenly among other NASP members and non-NASP members including re-sellers.
  • Not all secondary market participants, however, share equally in industry profits.
  • Some industry experts believe JGW/Peachtree's share of the estimated 2012 industry profits of $120 million was $100 million, or 83%.
  • Many new secondary market participants, including re-sellers, who began entering the market in 2009, are experiencing lower profits (or losses) in 2012 according to industry experts interviewed by S2KM. In addition, attorneys representing insurance companies report these newer (non-NASP member) factoring companies and re-sellers frequently lack legal and transactional knowledge ("don't know what they are doing") and cause an inordinate number of transfer problems.

Primary Market Response

As S2KM previously reported, continuing secondary market sales growth has occurred despite restrictive actions by primary structured settlement participants. Examples:

  • The National Structured Settlement Trade Association (NSSTA) continues to prohibit its members from "actively soliciting and promoting structured settlement factoring transactions to individuals who are receiving periodic payments under structured settlements?"
  • In Stone Street Capital v. McClendon, a Louisiana state court ruled that Travelers Insurance, as owner of structured settlement annuities, had no right to order structured settlement annuity issuers (in this case MetLife) to stop making payments to transfer companies following the death of the original annuitant/payees despite existing court orders approving those transfers.

Historic Metrics

Based upon interviews with industry experts and DBRS' June 8, 2011 Pre-Sale Report for J.G. Wentworth's Fixed Rate Asset-Backed Notes Series 2011-1, S2KM estimates the following historic (1986-2012) structured settlement secondary market metrics:

  • 136,000 transfers - involving 68,000 structured settlement recipients.
  • $4 billion - aggregate sums paid to transferor structured settlement recipients. For comparison, S2KM estimates the primary market has sold $134 billion of structured settlement annuities since 1975.
  • $10.4 billion - aggregate periodic payments purchased by secondary market companies.

2012 Secondary Market Developments

  • Vermont became the 48th state to enact a structured settlement protection statute. The new Vermont statute is generally based upon the NCOIL Model Act with some variations related to independent professional advisors, notice requirements for certain state agencies and the required court appearance by the structured settlement payee.
  • JLL Partners, owners of J.G. Wentworth, are reportedly attempting to sell the company for $1 billion with several private-equity firms identified as potential purchasers.

Evernote is an organization tool for iPhones, iPads, and other mobile devices. The application can also run on Microsoft Windows, Mac OS X, and various Internet browsers. On your computer Evernote can copy selected windows on the screen, including web pages if your browser supports it. You can then mark these copies with titles and organize them into notebook, archiving them in a number of ways.

On mobile devices, items you?ve copied can be synced directly to the Evernote cloud service, so you?ll never lose any of the information that you?re organizing. You can also take pictures from your smartphone or tablet and save them directly onto your Evernote account. You can also add GPS tagging and audio comments to each of the pictures you save.

There are hundreds of ways you can use this tool to your advantage. Many companies have switched to Evernote as their central filing system, abandoning physical paperwork altogether. Students use it as a great way to take written notes and keep track of their school work. Families use it as a cheap way to store their photos through a cloud service, versus an unsecure hard drive.

Pomodoro Technique

Developed back in the late 1980s, the Pomodoro technique is an incredible time management system that involves working in short focused waves. The basic idea is to use a timer and work on a single task for 25 minutes without any interruption, and then take a short break for 5 minutes. This takes a lot of pressure off a particular task while discouraging unnecessary multitasking.
The Pomodoro technique allows you to make calculated progress on all of your tasks by encouraging deep concentration without distractions instead of tackling it all at once and feeling overwhelmed. It?s simple, but very effective, and keeps you focused on what?s most important.

Steps:

  • Select a take you need to accomplish today.
  • Set a timer for 25 minutes and begin working on that task.
  • When time is up, take a short 5 minute break.
  • Repeat.

Every 4 cycles, take a 25 minute break.

You?ll notice after trying it that the Pomodoro technique is very easy to remember and follow. It doesn?t require any special software, lists, or other medium. You can practice it with anything.

Zendone

Are you eager to win the next big lottery? BloombergBusinessWeek writer David Samuels offers the cautionary tale of Jack Whittaker, a contractor in Scott Depot, W.?Va., who 10 years ago found that his $1 Powerball lottery ticket had won him a $93 million payout after taxes.

Mr. Whittaker tried to do good with his bonanza, giving away a good portion to charitable groups, especially churches. But he still descended into alcohol addiction; was divorced by his wife; became tied up (by his own count) in some 460 legal actions; and lost his beloved granddaughter, on whom he had lavished piles of cash, to drug addiction. Before his lottery ?win,? Whittaker?s contracting business had afforded him a comfortable life. ?Nobody knew I had any money,? Whittaker said. ?All they knew was my good works.? His life back then, he notes sadly, ?was a lot easier.?

Judge approves Toyota's settlement

SAN FRANCISCO --?A U.S. judge granted preliminary approval on Friday to Toyota Motor Corp's $1.1 billion settlement of a class-action lawsuit brought by consumers who lost value on their cars due to sudden, unintended acceleration.

U.S. District Judge James Selna in Santa Ana, Calif., scheduled a hearing in June for final approval of the deal, which was announced this week. It provides $500 million in cash for plaintiffs, plus installation of break override systems and a customer support program valued at about $600 million combined.

"Settlement will likely serve the interests of the class members better than litigation," Selna wrote.

Plaintiff lawyer Steve Berman said he was pleased with the favorable comments in Selna's order. Toyota spokeswoman Julie Hamp said the company was gratified by Selna's approval of the settlement, "which will provide value to our customers and provides an extra measure of confidence in their vehicles."

About 16 million Toyota, Lexus and Scion vehicles sold in the United States spanning the model years 1998 to 2010 are covered by the settlement. Company officials have maintained that the electronic throttle control system was not at fault, instead blaming ill-fitting floor mats and sticky gas pedals.

A study by federal safety officials at the National Highway Traffic Safety Administration and NASA found no link between reports of unintended acceleration and Toyota's electronic throttle control system.

Toyota, the No. 3 automaker in the U.S. market, admitted no fault in proposing the settlement, one of the largest U.S. mass class-action litigations in the automotive sector. One plaintiff's law firm called it the largest settlement in U.S. history involving auto defects.

However, the deal does not cover wrongful death or injury lawsuits, believed to total more than 300 according to a Toyota filing in June.

Toyota's recall of its vehicles between 2009 and 2011 relating to the unintended acceleration issue hurt its reputation for reliability and safety.

But the automaker's sales were up almost 29 percent in 2012 through November, compared with a 14 percent increase in the industry, and Toyota's share of the U.S. market has risen to 14.4 percent from 12.7 percent in 2011.

In his order on Friday, Selna said the settlement is fair, given the risks of further litigation and the complicated legal rulings he has issued throughout the case.

"Some of these rulings have been favorable to plaintiffs, some have been favorable to Toyota," Selna wrote. "Were the parties to proceed to a fully litigated result, virtually any outcome would face the risk of uncertainty upon appellate review of these rulings."

Selna also approved up to $200 million in attorneys' fees, saying the amount falls within 25 percent of the total settlement which is the benchmark established by appellate law.

J.R. Smith Buzzer Beater: Knicks Edge Suns, 99-97, After Two Difficult Jumpers (VIDEO)

PHOENIX -- J.R. Smith sank a baseline 21-footer at the buzzer after a Phoenix turnover with a second to play, giving the depleted New York Knicks a 99-97 victory over the Suns on Wednesday night.

Smith's tough jumper from 15 feet had tied it at 97 with 10.6 seconds left. Then, after the turnover, Jason Kidd inbounded to Smith, who got the shot off as he sailed toward the out of bounds line. Smith scored 27 and Kidd 23.

Jared Dudley had a career-high 36 for Phoenix, including two free throws that put the Suns ahead 97-95 with 34.5 seconds to go.

New York was without the NBA's No. 2 scorer Carmelo Anthony (hyperextended knee) and Raymond Felton (sprained finger), both hurt in the Christmas day loss to the Lakers in Los Angeles.

The Knicks said X-rays on Felton's right fifth finger revealed a fracture and the next course of action will be determined after his return to New York.

The Suns lost Goran Dragic in the final seconds of the first half when he was undercut by Smith on a layup attempt and fell hard to the floor. Dragic had bruises to his hip, back and wrist. Smith was called for a flagrant foul on the play.

Chris Copeland and Tyson Chandler added 14 points apiece for the Knicks.

Dudley, whose previous high was 33, was 11 of 17 shooting, 5 of 8 on 3s, and 9 of 9 at the foul line. Marcin Gortat added 13 points for the Suns, who lost their third in a row.

New York led 54-44 at the half and stretched it to 68-54 when Smith made a fadeaway, falling-down 19-footer with 7:13 left in the third. Dudley responded with a 3-pointer and the Suns were off on a 20-4 outburst. Another 3 by Dudley tied it at 72 with 2:10 to go, and Shannon Brown, who made just one of his first 7 shots, scored on a fast-break layup to put Phoenix ahead 74-72 with 1:23 left in the quarter.

It was knotted at 76 entering the fourth.

Dudley was fouled by Copeland on a 3-point try and made all three free throws to put Phoenix up 90-86 with 5:19 left, but Smith scored the next four, Kidd sank a 3 and Copeland made a 21-footer in a 9-0 spurt that had the Knicks up 95-90 with 3:34 left.

After a scoreless 1:28, Sebastian Telfair made a 3, then Brown sank a 20-footer to tie it at 95 with 1:15 remaining.

Smith missed a jumper from the top of the key 52 seconds from the finish and the Suns got the ball. Dudley was fouled on a drive to the hoop and made both free throws to make it 97-95.

But Smith, with P.J. Tucker all over him, sank a fade-away from just outside the free throw line with 10.6 seconds remaining to tie.

Phoenix coach Alvin Gentry called a 20-second timeout but the play broke down and, when Telfair tried to hit Marcin Gortat for a back-door layup, the ball was knocked back into the backcourt. Telfair chased it down but wound up stepping out of bounds with a second on the clock.

After a timeout, Kidd tossed the inbounds pass to Smith, who got the shot off, again over Tucker, from just inside the 3-point line. It went in and he was mobbed by his teammates.

The Knicks were missing a little over 43 points per game without Anthony and Felton, the first game this season that New York had been without both of its top two scorers. Rasheed Wallace also was out with a sore left foot.

Notes: The Knicks complete their brief three-game trip west at Sacramento on Friday. ... New York has lost two in a row only once this season. ... Michael Beasley, a big part of the second-half surge, missed Sunday's home loss to the Clippers due to illness.

Schumer still confident fiscal cliff deal possible

(AP) ? A Senate Democrat says he believes "odds are better than people think" that a deal can be reached to avoid automatic tax increases and spending cuts next week.

New York's Chuck Schumer tells NBC's "Today" show he's encouraged that Senate Republican Leader Mitch McConnell of Kentucky is getting "actively engaged" in talks to resolve the problem.

Appearing on the same show Friday, Republican Sen. John Thune noted a meeting later Friday among President Barack Obama and congressional leaders, saying, "It's encouraging that people are talking."

The South Dakota senator said, "I think in the end we will get a deal, but the question is the timing of that."

He also said the two sides are at stalemate because, quote, "Democrats haven't been willing to discuss the issue of spending."

Western Digital MyNet AC1300


Western Digital's MyNet AC1300 is the company's first pre-draft 802.11ac router. Western Digital?only recently got into the wireless router market with its debut router, the MyNet N900 this past summer. While the MyNet N900 is a surprisingly good first effort, the AC1300, when tested in 11ac mode, gave some of the lowest throughput we've seen among the current crop of 11ac routers; lost its Internet connection a couple times; and did not provide the QoS streaming improvements we saw with the N900. On the plus side, the AC1300 provides excellent throughput at 5GHz in 802.11n and offers the same uncomplicated setup and attractive interface of the N900. Still, on the merits of 11ac alone, there are better pre-draft 11ac routers. Western Digital's own MyNet N900 is a more impressive router in general.

Specs
The MyNet AC1300 is similar in design to the MyNet N900 except that it's smaller and has an all-black casing opposed to the black and silver housing of the N900. Another difference between the two: Western Digital surprised the consumer networking world by going off the beaten track and adding seven Gigabit LAN ports to the rear panel of the N900 instead of the standard four. The AC1300 has just the four Gigabit ports. I was a bit disappointed that Western Digital did not also offer the extra three LAN ports that made their first router stand out from the pack.

On the front of the router are fours LEDs representing power, wireless status, WAN, and USB device connectivity. A WPS button for connecting clients at a touch is also on the front. WPS works very well with Western Digital's router as I found when connecting the AC1300 to its companion MyNet Wi-Fi bridge.

The rear of the device has four Gigabit LAN ports, WAN port, two USB ports, a reset button, and a power button.

The AC1300 is a dual-band router supporting up to 450 Mbps on the 2.4GHz band and 1300Mbps on 5GHz.

Setup
Western Digital has one of the easiest router setups on the market, rivaled by the setup process of Cisco Linksys' Smart Wi-Fi routers. While the router ships with a setup and resource CD, a hard copy guide is included in the packaging. The guide details through illustrations how to set the router up in five steps.

The first couple of steps show how to plug in the power adapter and connect cables. As soon as the router is powered on, two default SSIDs are already created for connecting clients. Once I connected a Windows client to the 2.4GHz WLAN, I received a message in Windows, "Do you want to set up your network? This is a new router that has not been set up. Click OK to start set up."

After I clicked "OK," I was prompted to enter the router's eight-digit PIN. This PIN is printed on a sticker affixed to the underside of the router. A wizard then walked me through giving my wireless network a name and setting up security.
This completes the router's initial set up; from there, you can access the router's interface for further configuration.

Features and Settings
The AC1300's interface is the same My Dashboard interface that I liked in the MyNet N900. As in the N900, the AC1300's web-based GUI displays a nice round-up of initial "to-do" tasks via a notification message drop down list in the home screen. The notifications provide a good reminder for customers to perform important specific configurations such as changing the router's default admin password.

The home page dashboard provides an overview of the AC1300's settings such as SSIDs, Internet connection status, number of devices connected, and more general information about the router and network.

Through the dashboard, you can also see any USB devices connected and if parental controls are enabled. There's an advanced settings tab which will allow configuration of more granular features including WAN, IPv6, and Dynamic DNS settings.

The features have not changed since the launch of the N900. You can read that review for a more in-depth overview of specific features such as parental controls. As with the N900, there aren't a lot of advanced capabilities to make this a router a choice for many small businesses. There's no VPN server and IPv6 support is light. However, there are robust settings for home networks. For instance, you can create up to 32 firewall rules, enable MAC filtering, and Application Level Gateway (ALG) which allows traffic such as PPTP, IPSec, and SIP for VoIP to pass through the network.

You have some very light NAS capabilities through the software. I was pleased to see when I added a flash drive, the AC1300's interface picked right up on the drive's make, model, and capacity.

Multimedia
Western Digital's big push behind its MyNet line of router is that they are optimized for multimedia.? FasTrack QoS is Western Digital's proprietary Quality-of-Service feature that's baked-into the AC1300 (and the N900, as well).

For streaming Internet content to a home network, the speed of streaming largely depends on how fast your Internet connection is. Yet, with the FasTrack QoS enabed on the N900 router, time to buffer and play a movie from Netflix decreased about ten seconds. I did not see the same results with the AC1300. I did see slightly better streaming on the internal network with FasTrack enabled on the AC1300, decreasing the time to buffer and stream a movie from one client machine to another about 3 seconds.
In fairness, other router manufacturers also offer some sort of multimedia streaming enhancement. I tested Netgear's solution on its R6300 router and time to stream and buffer a Netflix movie was reduced about six seconds. For streaming within the network from device-to-device, the R6300's QoS shaved also about three minutes off time to buffer. With Belkin's AC 1200 DB Wi-Fi Dual-Band AC+ Gigabit Router, that buffering time was shaved about a second and-a-half.

So I don't see huge difference with streaming with proprietary QoS technology enabled or disabled among different routers. However, QoS is more helpful when streaming within a network between devices, and is also dependent on capabilities of a client's wireless adapter. I did receive better streaming in testing with Western Digital's N900 than with the AC1300, using the same file and equipment, which is a bit puzzling.

Further Issues
I have to note a couple of times during a course of two-day testing; two clients I had connected to the AC1300 lost Internet connectivity. When I went into the router's interface, I saw a notification message stating that Internet was not set up. I quick on and off of the router resolved the issue (and reconnected the clients) but the software seems a bit buggy. I also noticed at times, some slow responsiveness switching through differed settings pages within the interface.

Performance
With an 11ac router, the main criterion in gauging performance is throughput at the 802.11ac mode. Of course, with the exception of D-Link's Wireless AC1200 Dual Band USB Adapter (DWA-182) , there are no compatible 11ac wireless adapters for clients on the market.

Instead, I tested 11ac throughput using Western Digital's 11ac MyNet Wi-Fi Bridge, Intel's 3x3 6300 AGN wireless adapter, and D-Link's DWA-182 USB adapter.
Unfortunately, as compared with other pre-draft 11ac routers, the AC1300 gave some of the lowest throughput in 11ac mode. At 15 feet, its wireless throughput averaged 75 Mbps. This is quite below other 11ac routers such as the Asus RT-AC66U, which averaged 129 Mbps at the same distance; Cisco Linksys' Smart Wi-Fi Router AC 1750HD Video Pro EA6500 ?which tested at 133 Mbps; and Buffalo's?AirStation AC1300/N900 Gigabit Dual-Band Wireless router which managed 187 Mbps at the same distance.?

In 802.11n mode at the 5GHz band, the AC1300 fared better. It cranked out speed only second to the Cisco Linksys EA6500. At the 2.4 GHz band, in Mixed mode, the AC1300 did not again, perform as well as the Asus or Buffalo router. Western Digital's device also had worse range, decreasing 30 percent in throughput testing from 5 feet and then from 30 feet away from the router.
While performance in 5 GHz 802.11n mode was excellent; overall, the AC1300's throughput and range was underwhelming.? Below are charts comparing it to other pre-draft 11ac routers:

Second Router Not as Impressive as Debut
The AC1300 is the second router I've tested from Western Digital and, frankly, it's not as impressive as Western Digital's debut MyNet N900. The performance at 11ac mode, even using Western Digital's 11ac bridge was below that of several competing 11ac router. The range drop at 2.4 GHz mode is also troubling. While the same good interface from the N900 is carried over into the AC1300, it's unfortunate that Western Digital did not retain the seven LAN ports. Finally, I saw no improvement with multimedia streaming.

The AC1300 is a 3.5 out of 5 star earner for consumer routers; the current Editors' Choice being the Cisco Linksys EA6500 has better throughput, just as easy a setup and better range in 2.4 GHz Mixed mode?a common mode most home users are likely to use.

Hawaii lieutenant gov. picked to fill Senate seat

HONOLULU (AP) ? Hawaii's lieutenant governor and former head of President Barack Obama's 2008 election effort there has been named the state's newest U.S. senator, a choice that went against the dying wish of revered longtime Sen. Daniel Inouye.

Gov. Neil Abercrombie appointed Brian Schatz to the post Wednesday, instead of Inouye choice U.S. Rep. Colleen Hanabusa.

The 40-year-old Schatz, a former state representative and onetime chairman of the state Democratic Party, said his top priorities would be addressing global climate change, preserving federal funds used in Hawaii for things like defense spending and transportation, and getting federal recognition for Native Hawaiians for forming their own government, similar to many Indian tribes.

Schatz, who ran with Abercrombie for the state's top two offices in 2010, beat out Hanabusa and Esther Kiaaina, a deputy director in the state Department of Land and Natural Resources.

The three candidates were selected by state Democrats Wednesday morning from a field of 14. The candidates briefly made their cases before the state party's central committee.

"No one can fill Sen. Daniel K. Inouye's shoes, but what we want to do today is find the right person to walk in his footsteps," Schatz told the committee.

"I want to be your senator because I believe Hawaii needs seniority, and we need someone who can build it up over decades and decades. And I pledge to you, if I'm given this opportunity and obligation to serve, I will try to make this my life's work and rebuild the tenure that Hawaii so desperately needs," he said.

Schatz flew to Washington Wednesday night with Obama aboard Air Force One, who was returning from his Hawaii Christmas vacation early as Congress considers what to do about the so-called fiscal cliff.

Schatz was expected to be sworn in on Thursday, becoming Hawaii's senior senator. The state's other senator, Daniel Akaka, is retiring at the end of this Congress after 22 years.

Even before winning the 2010 general election, Abercrombie expressed faith in Schatz, saying he would put him in charge of attracting more private and federal investment in Hawaii. Other responsibilities included leading the state's clean energy efforts and Asia-Pacific relations.

"To the people of Hawaii, I can assure you this: I will give every fiber of my being to doing a good job for the state of Hawaii," Schatz told a news conference in Honolulu. "We have a long and perhaps difficult road ahead of us, but we can succeed if we work together. I understand the magnitude of this obligation and this honor, and I won't let you down."

Inouye, by far Hawaii's most influential politician and one of the most respected lawmakers in Washington after serving five decades in the Senate, died last week of respiratory complications at the age of 88. He sent Abercrombie a hand-signed letter dated the day he died, saying he would like Hanabusa to succeed him, calling it his "last wish."

Four days after eulogizing Inouye in the courtyard of the Hawaii Capitol, Abercrombie said he had to consider more than just Inouye's wishes in filling his seat.

"Of course Sen. Inouye's views and his wishes were taken into account fully, but the charge of the central committee, and by extension then myself as governor, was to act in the best interests of the party ... the state and the nation," Abercrombie said.

"The law makes explicitly clear, as do the rules of the Democratic Party, that while everyone's voice is heard and everyone's view is taken into account, nonetheless, no one and nothing is preordained."

Under state law, the successor had to come from the same party as the prior incumbent. An Abercrombie spokeswoman said the governor did not feel any political pressure from within his party to make the choice he made.

"While we are very disappointed that it was not honored, it was the governor's decision to make," Jennifer Sabas, Inouye's chief of staff, said in a statement. "We wish Brian Schatz the best of luck."

Selecting Hanabusa, 61, would have required a special election in Hawaii's 1st Congressional District. Last time that happened, Hanabusa lost to Republican Charles Djou because of a winner-take-all format that split votes between Democrats.

Abercrombie said the possibility of a special election was a factor, as well as Hanabusa's "key position" on the House Armed Services Committee. The governor said she was on her way toward establishing a senior position on that panel, and it's important for Hawaii ? with its four-member delegation ? to establish seniority in both chambers.

Schatz will serve until an election is held in 2014. He said he will run for re-election to try to keep the Senate seat until 2016 ? the end of Inouye's original term ? and would run again for Senate in 2016 if given the chance.

Hanabusa congratulated Schatz in a statement.

"Having served as chair of the Hawaii Senate Judiciary Committee when the succession law was passed, I fully respect the process and the governor's right to appoint a successor," she said.

Last week, when Abercrombie announced he would not seek the seat himself, his spokeswoman Louise Kim McCoy said Abercrombie intends to make his current post as Hawaii governor the last office of his political career.

Inouye would be "very happy" with the choice, Hawaii Democratic Party chairman Dante Carpenter said. Schatz has less experience than some older politicians in the Senate but he will be building seniority, which is "critical" to the state of Hawaii, he said.

"In the words of Sen. Dan Inouye ? invoked more than once ? seniority in the United States Congress is everything," Carpenter said.

Senate Majority Leader Harry Reid had urged Abercrombie to name Inouye's successor before the end of the year. The next Congress begins Jan. 3.

Democratic Rep. Mazie Hirono, D-Hawaii, was elected in November to succeed Akaka.

First in line to replace Schatz as lieutenant governor is Senate President Shan Tsutsui, who said he planned to discuss the prospect with his family before deciding.

'This' Man Grew Up Wanting To Be Married | Black and Married With ...

In late November I was in attendance at the Tyler?s Love and Life in Atlanta event. In fact, I was the event photographer as I?ve been for several of the Tyler New Media events over the past twelve months. During the engaging discussion on love and romance, I was struck by one of the featured panelist?s statements which I will paraphrase below:

Boys don?t grow up wanting to be married.

He went on to talk about little girls and their play wedding dresses and all the little fantasies that they have around a wedding and that boys just want to have that girl that is their friend, that will ride with them. And I am inclined to agree. I never once gave much thought to a wedding as a child. But something about his blanket statement didn?t sit well with me. And it took me a couple of days to figure it out: Personally, I?ve always wanted to be married.

Marriage Every Day

How could I not? First off, I saw marriage every day in my home. Even on the days my folks didn?t get along I wanted to be married. I just didn?t want to be married like them. And then there were days that I wanted multiple wives of different nationalities and backgrounds. A cousin informed me that unfortunately this was illegal in the United States. But even still, it was marriage that I wanted.

But what I wanted and what I got were too different things. Love, and even like avoided me for many years for no valid reasons. I was an ugly duckling, chided for my appearance and misunderstood for my shyness. Growing up, many of the girls I liked passed on me, preferring the more gregarious, muscular, personality-having types instead.

Love & Sex Are Not The Same

In college things went full circle. I had all but outgrown my youthful awkwardness and had evolved into a man ? who still wanted nothing more than real love from a woman. When I asked my first college love to be my girlfriend (yes, I actually asked) she told me she had a boyfriend back home and asked if we could just ?have fun together??in school. It wasn?t exactly a rejection, right? I actually considered her offer until another friend, a female best friend, strongly advised me, short of calling me crazy, not to, instructing me to ?never play second fiddle.? My young and impressionable mind and heart let those words sink in deep, so deep that I began to believe no one was to be trusted. I became ultra-suspicious and downright sinister if I felt someone was even hinting at taking advantage of me. I quickly became the king of the One Strike you?re out rule. I broke hearts before mine could be. I broke hearts just because. Then I crossed paths with an older woman, a twenty-two year old senior, who schooled me on how to selflessly love a woman. Then she left school and me to enter the real world.

Abandoned, alone and angry, but now officially ?trained? by a grown woman, from my perspective, I became downright lethal ? a master manipulator in the finer art of seduction, and even worse I never shared nor bragged to friends. But people talk and my reputation began to precede me well beyond the boundaries of my freshman class. But for all the ?fun? I was having there was a great emptiness inside me. No matter what the scenario or ?conquest? afterwards, I would typically feel broken and cheap. Little did I know then that I was suffering from a lack of love and only making matters worse by giving myself away for less than free to almost anyone who was interested. And because I wasn?t sharing, no one knew to tell me to stop or suggest there was a better way. Not that they would have. My peer group was a bunch of eighteen to twenty year old boys. There wasn?t much any of us could?ve done for each other at the time.

Enough Was Enough

By the time I was a senior I was over it: disgusted with myself and everyone around me. Profoundly sad that so women ?knew? me but didn?t know me at all. Mad at myself for bringing it all on myself. Frat brothers and friends looked at me like I was crazy when I talked about only wanting to make love unless I was in love. For women I was now the worst of all the guys ? the quiet one. No one ever knew my pain because I had done so much, in vain, to mask it with sex. No good woman was going to waste her time getting her heart broken by me so they just opted to pass the time. This followed me into adulthood where I evolved into ?the good time guy? ? the one you messed with when you want to be romanced and treated with respect, but not the one you stayed with. And of course, this led me down the dark path of adultery. I knew the risks but I took them anyway. I knew the bible verse too. As friends got married and divorced, cheated on their wives, etc., I simply didn?t get it. I would?ve given anything to have for a day what they couldn?t seem to appreciate at all. The final straw came when someone I truly cared for told me she would never fall in love again moments after being intimate. She was on the rebound from a divorce and speaking from her place of pain. She had no idea the impact of her words on me. I broke things off with her the next day and swore myself off women cold turkey. They weren?t the problem. I was. As fate would have it, the woman remarried and had a beautiful daughter. Such is life.

Eventually I got my act together when a wonderful woman found me while I was walking through midtown Manhattan on my lunch break. But it took me a long time to pull the trigger and pop the question. It angered her and she assigned all the appropriate terms to me: non-committal, indecisive and even immature. But what she thought was my condition were merely the symptoms of my longstanding hurt.

I don?t expect many men to openly express that they always wanted to be married. But I know as the person writing this post that one man did grow up wanting to be married. I wanted to be with that one person who was one with me. I saw it in my community and I valued it. I was too young and too much of a boy to know or care about the dresses and rings, but I did want that one woman to be mine, forever. I remember my first thoughts of this back from when I was in first grade. There have been plenty of hiccups and hurdles along the way, but that doesn?t change the fact I wanted a wife. How about you?

Broncos to finish season in style

The difference Peyton Manning has made in Denver actually is measurable.

Try from 8-8, which the Broncos were a year ago in winning the AFC West, to 12-3. Try losing their final three games of 2011 and sneaking into the back door of the playoffs to winning their last 11 and moving into the postseason as the NFL's best team.

Those are the numbers, along with Denver (No. 1 in the AP Pro32) being a 16-point favorite over Kansas City (No. 32, AP Pro32), which is 2-13.

What Manning has brought to the Broncos in swagger, confidence and performance that has been impressive even by the four-time league MVP's standards.

Don't look for any temporary respite in any of those areas against the weak Chiefs.

"We talk about that a lot, not coasting, pedal downhill," coach John Fox said. "I appreciate him. I think that's a big reason why he's accomplished what he's accomplished, whether it's here or in Indianapolis. He's a tremendous competitor, doesn't let up. AT HOME: DD: 18-21

When last we left the days of December Daily, we were?somewhere?around here, right?

So, here's what happened next. ?I ran out of divided page protectors and started sticking the photo and journaling cards all in this one pocket, which is just not nearly as?psychically?satisfying.?

Then I added a second page to Day 16. ?There were alot of cool stories besides opening presents on the 16th so I highlighted making E's paving stone, crazy boys' new undershirts and, I think, some Z & M at the farm stories. (The other pictures wandered off with M, but will make their way back I'm sure, right?)

The 19th I volunteered at B's school to help the kindergartners make "gingerbread" houses (yes, our third "gingerbread" house making this year. ?This is slightly ironic as B wanted to make one all year last year and we never did. ?Problem solved!) Only the first gingerbread houses this year involved actual gingerbread, this time it was graham crackers attached with icing to milk cartons. ?There were about 120 kindergartners at play with lots of adults helping out and so much candy! ?I hadn't planned on coming as it was a big logistical challenge to rework my job and pick ups for the other kids, but after Sandy Hook was reminded that I need to be there and take these opportunities. ?Also, I loved getting to help B and think he feels extra special when we're present for class activities ?and he is!

December 21 was supposed to be a play day for M and Grandma as M was off school, but everyone else was still "in." However, it ended up mostly being a sick day as E was sick, and M was getting there. ?They did have one adventure to the duck pond and watched some dance flash mobs on utube while E and I went to the Doctor (Yes, he has another double ear infection and is very miserable). ?

Ok, I will be back fairly soon with the 22nd and 23rd and then probably a few days later with the days that follow!
